Terms and conditions for Track ID

I was using Google to search for a song that was playing on the radio. The search started with "who sang" and before I could type more, Track ID found the song. Not within the app. But within Google.
The terms and conditions cite that access to the microphone is accepted, however access to Google search material is not within the permissions of the app nor is it contained in the terms and conditions. I would like an explanation for this please.
